Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Wingo Analyzer mobile application (“App”) and related services operated by Wingo Analyzer (“we”, “us”). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You represent that you are legally able to enter into a binding contract in your jurisdiction and that you meet any minimum age required by applicable law and by the Apple App Store or Google Play. If you use the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. The service
Wingo Analyzer provides software tools and AI-assisted analysis related to colour prediction and Wingo-style game formats. Features may be added, changed, or discontinued. We do not guarantee that the App will be uninterrupted, error-free, or available at all times.
3. Not gambling, financial, or professional advice
The App is provided for informational and entertainment purposes only. Outputs are generated by automated systems and are not guarantees of any outcome. We do not provide gambling, betting, investment, legal, medical, or other professional advice. You are solely responsible for your use of the App and for complying with all laws that apply to you, including laws relating to games of chance, betting, or prediction activities in your region.
4. Subscriptions and payments
Optional paid features may be offered through in-app purchases or subscriptions processed by Apple or Google. Pricing, billing cycles, renewal, cancellation, and refunds are governed by the applicable store’s terms and policies. We do not process or store your full payment card details. In-app descriptions and store listings describe current plans and limits.
5. Accounts
Where the App offers sign-in, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@wingoanalyzer.app if you believe your account has been compromised.
6. Acceptable use
You agree not to:
- Use the App in any way that violates applicable law or infringes the rights of others.
- Attempt to reverse engineer, decompile, scrape, overload, or disrupt the App or our systems except where permitted by law.
- Circumvent technical limits, payment requirements, access controls, or security measures.
- Submit unlawful, harmful, harassing, or infringing content through the App.
7. Intellectual property
The App, its branding, and materials we provide are owned by Wingo Analyzer or its licensors and are protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership interest. You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the App as offered.
8. Third-party services
The App may integrate or depend on third-party services (including AI providers, authentication, analytics, and cloud infrastructure). Your use of those services may be subject to their terms. We are not responsible for third-party services we do not control.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WINGO ANALYZER AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US FOR THE APP OR SUBSCRIPTIONS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY), UNLESS APPLICABLE LAW DOES NOT ALLOW SUCH A LIMITATION.
11. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Wingo Analyzer and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the App if you breach these Terms, if we are required to do so by law, or if we discontinue the service. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnity, where enforceable) will survive termination.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of India, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws. Subject to mandatory consumer protection rules that may apply in your country, you agree that the courts located in New Delhi, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the App, except where applicable law requires disputes to be heard in another forum.
14. Changes
We may modify these Terms from time to time. We will post the updated Terms at this location and update the “Last updated” date. Where required by law, we will provide additional notice. Your continued use of the App after the effective date of changes constitutes acceptance of the revised Terms where permitted by law.
